The top question surrounding the NCAA concussion lawsuit against Penn State is: Who will win and who will lose? The NCAA, which is the governing body of college athletics and was in charge of the investigations, will be left holding the bag for its involvement in a criminal act by its own athletes.
That does not mean the NCAA or any member school should be shielded from responsibility. There is no place for greed when you are trying to protect your student athletes. And, if any one is found to have taken part in the cover up then they may be held responsible, regardless of how their actions were intended.
The bottom line is the NCAA did nothing to keep its members from participating in the sport. It did nothing to help protect them in order to prevent them from suffering serious injuries. It was its own athletes who ended up suffering serious injuries. When they were injured they should have been made aware of the dangers.
The NCAA did nothing to make its athletes aware that there was a serious danger, or that they could receive compensation if they were harmed as a result of participating in the sport. For that reason, the NCAA and other colleges are being held responsible for the actions of their student-athletes.
In the current climate, where athletes are more concerned about how they will be perceived than how they perform, it is hard to blame the NCAA for trying to protect itself. Any member university that finds itself being involved in a criminal act will do everything it can to defend itself. The NCAA has the chance to make that defense, but it needs to step up and do so. Otherwise, the NCAA's reputation could suffer because of this lawsuit.
So, is the answer to the top question regarding a NCAA concussion lawsuit really in favor of the athletes? Or does the NCAA really need to be held accountable for the actions of its student-athletes?
If the answer is "yes" then the best course of action would be to end this lawsuit and let the students involved in the sport to move on with their lives. It is difficult to believe that the NCAA was not aware of the serious dangers that it put its student-athletes in by permitting them to participate in contact sports without protection.
For that reason the best course of action is to let these young men play without worry and allow them to face the serious dangers that may occur if they attempt to participate in contact sports without protection. Even though the NCAA failed to educate its players on these hazards, it is hard to believe that it was unaware of what it put them in. The athletes were told that they could get hurt when they engage in contact sports.
So, it is my opinion that the time has come for the NCAA to step up and start protecting its players from the serious dangers that it put them in. The current lawsuits being filed by plaintiffs will only create more negative publicity for the NCAA and its members.
