This may be possible but will depend on the nature of the case. There are many cases when the defendant does not enter into court proceedings and the plaintiff files suit in court. If you do decide to go to court, you will be required to prove the defect in order to win your lawsuit.
Although a product liability lawsuit is not a walk in the park, you will likely find it easier to win one if you have strong evidence to back up your claims. You may need to pay a fee for a lawyer, depending on how long it takes to bring the lawsuit to trial and the severity of the case. In the event that the lawsuit is lost, you may even have the option of settling the case for a lesser amount than what you are entitled to.
